Equity contracts of spouses and fiancés (prenuptial agreements)

The law in the Czech Republic sets forth that the property acquired during marriage is in a community property of the spouses. This may be however altered by equity contracts, which must be in a form of a notarial act. The contract may be entered into both during marriage and before marriage (a prenuptial agreement).

The contract may eliminate business risk consequences for community property, mainly in relation to liability for the debts of one of the partners, provided however, that a third party (a creditor) is acquainted with the contract.

All equity contracts of spouses and prenuptial agreements are recorded in a central registry of equity contracts at The Society of Notaries of The Czech Republic.
